President Nana Addo Dankwa Akufo-Addo has responded to the election petition of John Dramani Mahama, describing it as “incompetent, frivolous and vexatious”.
Mr. Mahama’s election petition challenges Akufo – Addo’s eligibility as winner of the 2020 General Election. According to Mr. Mahama no candidate obtained more than 50% of valid votes cast in the 2020 presidential election and therefore seeks a second election.
In responding to Mr. Mahama’s election petition, Akufo-Addo said the petitioner did not indicate the number of valid votes or percentage he should have obtained in the election or the number of votes or percentage he Akufo-Addo should have obtained in the election to support the allegations and request for the so-called second election.
Akufo-Addo in his response said Mahama’s election petition does not measure up to the legal criteria for an action invoking the Supreme Court’s jurisdiction under Article 64(1) of the Constitution. He added that those allegations stated by Mr. Mahama must be discarded. “Empty allegations of wrong aggregation of votes and votes padding” he said.
“The petition is merely conjectural and borne out of Petitioner’s unfounded imagination”, and further that the material facts in the Petition do not support the reliefs sought and, therefore, same should be dismissed in limine as “incompetent”.
Mr. Akufo-Addo said Mahama’s claim of having a higher total votes in Techiman South is a deliberate attempt to mislead the Supreme Court.
“The Petitioner’s persistent and strange claims to being entitled to all the votes of registered voters in Techiman South, contrary to his knowledge that the actual results from the constituency were declared shortly after the Electoral Commissions statement is not only mischievous but a deliberate attempt to mislead This Honorable Court”said Akufo-Addo
The petition is incompetent, frivolous and vexatious and discloses no reasonable cause of action in terms of 64(1) of the Constitution – Akufo-Addo’s response to Mahama’s election petition #CitiCBS— CitiNewsroom (@Citi973) January 11, 2021
Mahama’s conduct and that of some leading members of the National Democratic Congress (NDC) claiming victory with over 51% and seeking for a Re Presidential-Election was a calculated agenda to deceive the people of Ghana according to Akufo-Addo.
Mr. Mahama has refused to concede defeat to Akufo-Addo who was declared winner by the Electoral Commission chairperson(EC), Jean Mensa after a coalition of the 2020 Presidential election results.
